"Jason Stverak, president of the Franklin Center for Government and Public Integrity, recently wrote a Washington Examiner op-ed regarding the free speech threats which bloggers and other citizen journalists increasingly face.

This past December, federal judge Marco Hernandez of Oregon issued a ruling in the libel trial of Obsidian Finance Group v. Cox that has dangerous First Amendment implications.

Hernandez ruled that blogger Crystal Cox was not entitled to the same protection under media shield laws that other members of the press enjoy. This ruling made it easy for a jury to find her guilty of libel. That result threatens the First Amendment rights of all citizen-journalists.

With the Internet increasingly serving as the dominant source of information, a national debate has been taking place asking the question, who is a journalist? Legal scholars, journalism academics and First Amendment advocates all have their opinions and as expected, there is little agreement.

But why is this issue so complicated? Bloggers, like all citizens of the United States, have First Amendment rights. Has the definition of a journalist changed? Or has perception and therefore legal definition simply not adjusted to modern technology?

According to Professor Kyu Ho Youm of the University of Oregon School of Journalism and Communication, Judge Hernandez “ruled correctly” in the Cox case. But he also acknowledges that the ruling was based on his “textual interpretation” and that “pre-Internet law needs updating.”

Youm offers a wake-up call to state legislators. Media shield laws must be revised to make clear that bloggers and all citizen-journalists deserve the same protection as the city hall beat-writer at the local newspaper.

This is especially important, as technology and new economic realities have forced newspapers all over the country to cut staff drastically and in many cases, close up shop. The public now relies on citizen-journalists to perform an invaluable service to our democracy — serving as government watchdogs.

THE STATE OF MONTANA :

I, Stephen Mocko, being duly sworn, do state upon my oath that I have personal knowledge that I have good reason to believe and do believe based upon the following information:

On or about the night of August 19, 2009 I was forwarded an email by Crystal Cox. In that email it contained a death threat, inflammatory comments against her sexual orientation, and slander against her career, directed at Crystal Cox. I had noticed that the senders email address was crystalcoxisabitch@yahoo.com.

Crystal then informed me that it was from a Sean Boushie but could not get any proof. I then took it upon myself to write an email to this crystalcoxisabitch@yahoo.com in a threatening manner in the hopes to get this threatener to reveal their identity.

At this point I did not know it was a Sean Boushie. The next day I got a reply message from an email address by sean.boushie@mso.umt.edu.

I had no knowledge that this was the Sean Boushie that Crystal Cox had told me about.In that fact how did this sean.boushie@mso.umt.edu get my email address ofnotyranny59917@yahoo.com to send a reply?

On the morning of August 28, 2009 at 8.57am, Pacific Standard Time, I received a call from Officer Maury McKinney from the Lincoln County Sheriff’s department.

Officer McKinney asked if I had sent an email to a Sean Boushie. He did not ask if I had sent an email to the email address crystalcoxisabitch@yahoo.com. He then proceeded to read the letter I wrote to crystalcoxisabitch@yahoo.com.

There was one question that came to my mind.

How did he get that email?

Only Sean Boushie, who filed my letter that was sent tocrystalcoxisabitch@yahoo.com with Officer McKinney, could have written that threatening and slanderous email against Crystal Cox.

Attached hereto as exhibit A. This is circumstantial evidence according to 26-1-102(1) Montana Code Annotaded 2009, that Sean Boushie did in fact write the threats on her life, and purposely caused Crystal Cox to omit her performance of her daily life with the fear that Sean Boushie will carry out his threat on her life.

and I charge that heretofore, and before the making and filing of this complaint, on or before the ____ day of ___________, _____, in the19 Judicial District court, County of Lincoln and the State of Montana, Sean Boushie , did then and there unlawfully and willfully violate Section 45-5-203 Montana Code Annotated, a Forcible felony defined by 45-3-101(2) Montana Code Annotated, against the peace and dignity of the State. "

Bernie Cassidy, Lincoln County Attorney And Judge Robin Clute Hamilton Montana Concealed Material Evidence

Bernie Cassidy, Lincoln County Attorney And Judge Robin Clute Hamilton Montana Justice of the Peace Concealed Material Evidence and in this I was given an Undo, Illegal, Immoral Protective Order Against me. The Man I Feared was given a Protective Order Against ME. I had to Stay Away from him and to NOT Write about him. This was an attempt to Scare me - STOP me from Writing on Corruption in Lincoln County Montana and Ravalli County Montana.

Lincoln County Montana Officials and Ravalli County Montana Officials Really Wanted to SHUT me up in the Summer of 2009. I was writing on corruption in the Lincoln County Montana and Ravalli County Montana Justice System and it was Election Time. Plus the Corruption I was Exposing was digging into Decades of Dirt on Lincoln County Montana Officials and Ravalli County Montana Officials and they could not afford for the Truth to Get Out, so they Made me, my life, my career .. their Collateral Damage in a Political War that had NOTHING to do with Me.

In July of 2009, I got into an online Spat with a man, and Lincoln County MontanaOfficials and Ravalli County Montana Officials grabbed onto him and gave him the red carpet treatment to Shut Me Up. I claimed he sent me a Death Threat, they all say to this Day that I sent it to myself. Well it was Pretty Graphic and Quite Sick, I would not have sent that around. No Way. I have also been accused of being Coached by "Paul Stramer", thing is I had never had a Private Conversation with Mr. Paul Stramer until I received this Death Threat and was asked by his attorney to testify on his behalf.

I was Denied Protection and No Lincoln County Montana Officials and Ravalli County Montana Officials, or Missoula County Officials have to this day even TRIED to prove where my Death Threat came from. Why? Because they knew from the Start who sent the threat and they had the Hard Proof.

The day I first took my Death Threat to City Judge Stormy Langston in Eureka Montana, as she is Also the Justice of the Peace in Eureka Montana, however that particular Day she was at City Court in her "Judge Job" there. She Told me that day she knew for sure it was the man I said it was, she said she would give me a protective order. Then She changed her mind and said well I can't prove where it came from. BULL. The Technical Evidence was Massive and NO One even Tried to Prove where it came from.

Next thing you Know, One of My Bloggers sends a Snotty Gram to the Email account that Sent my Death Threat, he did not know who he was sending it to. Then a couple days later, SeanBoushie files a Police Report claiming that Stephen Mocko threatened him, the Email was the Evidence. This proved without a Doubt who had access to the eMail account that sent me a Death Threat. When I found out, that there was a Complaint Filed with the Eureka Montana Police Department, I called right away. I spoke with Officer Grey, I Taped that Call - Click Here for Call . I was told that Officer Maury McKinney took that Complaint. So Officer Grey says so, and So did Officer Maury McKinney when At my Door. Thing is that Complaint was never allowed as "Evidence" to me. My Defamation Lawsuit was Blocked by Bernie Cassidy, Lincoln County Attorney with LIES to my attorney that There was an investigation when there was not.

When County Police Officer Maury McKinney served me the Corrupt Protective order from Hamilton Montana Justice of the Peace, I asked him if he had received that complaint, he said he did and that it was sent to Bernie Cassidy - Lincoln County Attorney.I recorded that Visit to my door for my own protection. County Police Officer Maury McKinney told me he took the complaint, and I said well that proves who sent my Death threat. He said well you can't really tell... BULL it is Technical Evidence, easily proven. Thing is County Police Officer Maury McKinney is Friends with the Man I Claimed threatened to Kill Me.

Bernie Cassidy, Lincoln County Attorney had the Evidence all along and Concealed it therefore Blocking my Defamation Lawsuit, and setting me up for a year protective order, 15 months and counting of harassment and Stalking, and severe Defamation to the Point of Losing Massive Real Estate Commissions.

So even though many still claim That I Controlled that account and I emailed myself that death threat, well hmmmm why did the man I accused of sending it .. get an email sent to that account and file a Report at the Eureka Police Department with County Police Officer Maury McKinney? He had to have access to the Account to Get that Email Right?

Judge Robin Clute Knew of the Complaint, and She WOULD not allow it in her Court. My Aggressor, Wrote the Complaint as part of his evidence in the "Reasons" he should be protected from me. Click Here for More on That.

Judge Robin Clute would not let him admit that Complaint into Evidence as it proved the WRONG thing, and she needed to Set Me Up. See it PROVED without a Doubt that He was the Aggressor and NOT me, so That's Easy SHE told him in Court... a Supposed Court of Record Right? Well I Recorded it for my Protection, she told him he could not admit the Stephen Mocko Complaint into evidence.

Therefore Judge Robin Clute , Hamilton Montana Justice of the Peace Concealed Evidence, with intent to endanger my life and to ruin my business.

Also Judge Robin Clute would not allow any information that I Received from Hamilton District Court Judge Haynes, though this quoted the Montana Law that Said there was No Protective Order LEGAL in this Situation. Judge Robin Clute gave this man a Protective Order and did not make it Mutual.

The Protective Order given Against me had NO base in Fact, no Proof of a Threat or Fear, No Base in Law and Yet Judge Robin Clute Hamilton Montana Justice of the Peace gave him one anyway. Judge Robin Clute Hamilton Montana Justice of the Peace is Above the Laws of the State of Montana, Violates Constitutional and Civil Rights and Has, In my Opinion NO Moral Conscience. I was telling the Truth all Along.

This Man has continued to Stalk, Harass and threaten me for 15 months and counting. Meanwhile Lincoln County Montana Officials and Ravalli County Montana Officials spread information that I have Lied, that I have a Bad Reputation and that I am being "investigated" when this is Not True. The FBI is NOT investigating me, I have done nothing against the Law, and there is No Legitimate Investigation on me.

These Flat Out Lies and Defamation has Cost me Major Commissions in My Real Estate Company, and Cost me PR Jobs Online. This Severe Defamation was NOT based in Fact What So Ever, it was an Attempt to Cover Up Corruption in Lincoln County Montana and RavalliCounty Montana. I was never Charged with anything at all, I was simply harassed, discriminated against and defamed. All to protect Corruption in Lincoln County Montana and Ravalli County Montana.

The Lincoln County Sheriff Department and the Montana Corruption that attempted to STOP me from telling the Truth on them, they told other State and Federal "Authorities" that I was being investigated, when I Was NOT. And this made it so the Missoula Police, the University of Montana Police, the State of Montana Officials, and More Simply Dropped my Complaints... my Requests for Protection as I became the Criminal when in Fact I was the Victim.

This Also put me on some sort of Homeland Security Watch list as I am detained at Airports and told that I am showing as a "Security Risk" on their Computer Screens and All because I Exposed Judicial Corruption and Corrupt Law Enforcementin Lincoln and RavalliCounty Montana. So now I cannot freely travel without suspicion, when I did not do anything against the law or threatening in ANY way.

Bernie Cassidy, Lincoln County Attorney And Judge Robin Clute Hamilton Montana Justice of the Peace could have subpoenaed Google, Yahoo and other sites in a few minutes to find the Real Identity of the person who sent my Death Threat. But Instead Bernie Cassidy, Lincoln County Attorney And Judge Robin Clute Hamilton Montana Justice of the Peace IGNORED my Constitutional Rights, Failed to Investigate and Did nothing to Prove the Facts in my Case. Therefore I Suffered over 15 months and counting now of Defamation, Threats, Harassment and to this Day Bernie Cassidy, Lincoln County Attorney And Judge Robin Clute Hamilton Montana Justice of the Peace have Concealed Material Evidence in my Case. They have Known, without a doubt for over 15 months WHO Threatened to Kill me and they did nothing to protect me and instead turned it all on me..

August 21st 2009 - the Day I Went to Hamilton Montana to Get a Protective Order.



After This Clip, we Were met outside by 6 Hamilton Montana Police Officers. Only one was concerned with why I came there, with real justice and real facts. The Other 5 simply cornered, questioned and harassed Michael Spreadbury Whom I had just met in person the Night Before.

Not one of those Hamilton Montana Police Officers investigated my case, and one cop from Stevensville did take me aside and give me advice... however it was like it was helping me in secret, for he said this was in the Hamilton Courts and Hamilton Cops Jurisdiction...

See the Point of 6 cops showing up and within minutes was to Discredit Michael Spreadbury to protect the Wall of Corruption in Hamilton Montana and the point was NOT to help Montana Victims seeking Justice with Hamilton Montana Police, Hamilton Montana Judges, and Hamilton Montana Courts.

Perry Backus of the Ravalli Republic Newspaper showed up within minutes, NO one was interested in why I was there or what was really going on, the 6 cops and Perry Backus of the Ravalli Republic Newspaper were interested in harassing Michael Spreadbury.

See My Death Threat Talked of Tons of Bullets, and Guns.. and all kinds of horrible threats and not just to me but other Montana Citizens, and in the Best Interest of Ravalli County Tax Payers and all of Montana, those 6 Hamilton Montana Police Officers should have took a good look at my threat, which in minutes with a fax to google, yahoo or the other proof I brought.. . they could have tracked the Source.. but the motive of those 6 Hamilton Montana Police Officers and of Perry Backus of the Ravalli Republic Newspaper was to shut up, discredit, silence, create a fake story on Michael Spreadbury. Why? Well because Michael Spreadbury, protect supposedly under Montana Media Laws, well he was writing on the Corruption in the Hamilton Police Department, Corruption in the Ravalli County Attorny Office and Corruption within the Hamilton Montana Justice system as a Whole. And my Constitutional Rights or those 6 Hamilton Montana Police Officers doing their actual job was not what they were there for. And it was certainly not the Story that Perry Backus of the Ravalli Republic Newspaper was looking for.

My Death Threat, My Wanting a Protective Order had Nothing to Do with Michael Spreadbury. I went to Hamilton Montana because the Man I feared lived there ... I went to film the Denny Rehberg Listening Session, I went to Interview for the Documentary Beneath the Beauty - Yet
those 6 Hamilton Montana Police Officers made My Story out to be all about this man I had just met, all because he was telling their dirty little secrets on the Internet.

I Called Perry Backus of the Ravalli Republic Newspaper, a couple hours after I left the Court House and told him not to print anything before he got my side of the story. Once Perry Backus of the Ravalli Republic Newspaper got my side, nothing was printed as the Point of Perry Backus of the Ravalli Republic Newspaper was to get something incriminating on Michael Spreadbury and was not to actually write the real news that would affect Hamilton Montana Citizens. Though you all had a right to know..

Michael Spreadbury did not say much, basically he just gave me a ride from the Denny Rehberg listening session as I was interested in his story and wanted to visit him.. it certainly exploded into something far stranger that I had ever anticipated..

Why Does a Hamilton Montana Judge give an Illegal Protective Order against a Woman in Eureka Montana 2 Counties and 5 Hours Away? Neither Party lived in Hamilton Montana and I certainly only went there for the Corrupt Court Smack down of my Rights.

Judge Robin Clute sure was scripted that day, she let my Aggressor talk 45 minutes, she read the Complaint, admittedly for the first time in front of me, she let my stalker hear my Social Security Number.. she admitted no evidence that I brought or requested... "In My Opinion Judge Robin Clute has Violated my Human Rights, Discriminated Against me and Put my Life in Danger.

I mean no disrespect to the Honorable Judge Robin Clute, However, I feel that I have been violated, disrespected and my life put in Danger. I feel I have been discriminated against and that Robin Clute has put my life in a very precarious place, now this Man.. this Sean Boushiewho I have proved is Stalking me, now he can walk right up to me and yet I have to stay 1500 feet from him.

He is Dangerous, he has written foul threats online about me, he has threatened to permanently put me down, he has a Concealed Carry Permit. Sean Boushie Collects Guns, Makes Guns, Brags of How Much ammunition he carries.

Judge Haynes said if he was not my boyfriend, not a family member he could not give me a protective order. I was denied Protection in Ravalli County and now I have to go back there as if I am the aggressor. What is Wrong with this Picture? Do I have no Rights what so ever?Why?

Their is an Item on the Protective Order Issued by Robin Clute that claims there is an email from a S.M. - and that I put this guy up to that email. This email was sent, and Sean Boushiedid file in the Lincoln County Courts over that. I certainly did not put the guy up to it. The thing is the Email was not sent to Sean Boushie, the email was sent to No One.

My death Threat came from the Email Address CrystalCoxIsABitch@Yahoo.com - this S. M. Guy sent an email to that account, telling that person whoever it was, the mystery person, the guy who threatening to Permanently Put me Down and bragged about his hatred and how much ammo he carries... telling this person what he thought of them. The next thing you know Sean Boushie surfaces and calls the local cops in Eureka Montana to file a Report against this guy.

Obviously the immediate question that arises is how did Sean Boushie get that email. How did he Check that particular email account, assume the message was for him and then file a report and why in the world would Law Enforcement let him file a report claiming he was threatened if he did not own that email account that sent me a Death Threat. And now my Protective Order violating my Human Rights, given by Judge Robin Clute, this order claims that there is evidence to this email that was given with the judgement, the request to be protected from me due to a claim of a fear of safety. Did Robin Clute get this email, is it in her file, this directly ties Sean Boushie to my Death Threat and now she has issued a Protective Order for Him, against me.

I don't know if Ravalli County Judges Hate Woman in general or if it is just me. I don't know if Judge Haynes was within bounds on local law, or denied me for political reasons NOT connected to me. I don't know if Robin Clute was in bounds within the law with giving her order of protection. I do know that She has stripped me of all rights, as I have to stay away from a Man I have not seen in 14 years, don't know what he looks like these days, don't know what he drives, and he has given Robin Clute Photos of me, he certainly knows what I look like and can legally walk right up to me. With This I feel violated in ways I cannot begin to describe and a Woman Judge, Shocking .. really shocking... No Justice ..

Yahoo can and will soon verify what IP address checked this email, it was certainly nothing to do with me. The Courts will eventually have to turn over Sean Boushie's report to someone and this will all come out into the Court System.

Until Then Judge Clute has left me helpless and I want you folks of Hamilton of Montana to know this, there is reports the day I was in Hamilton to get Protection, there is video and signed documents of me being Denied, and Now this.. the Honorable Judge Clute has givenSean Boushie Protection from Me, I have NEVER ever threatened to do anything to him, never been to his home, never been up to his car, never spoke to him. He harasses me, sends me cease and desist letter for talking about his letter to the editor on my blog, emails me hate, endangers me, THREATENS me and then tells a Hamilton Judge he fears me and he is Given an Order of Protection.

After a Month of Trying to Get Protection to protect me FROM Sean Boushie, after talking to Hamilton Police, Missoula Police, University of Montana Police and Being Denied a Right to Protection by Judge Haynes in Hamilton, in writing, and being denied a protective order in Eureka due to lack of evidence at that time.. now all he has to do is make stuff up about me, say he is scared of me and Judge Clute gives him and Order of Protection. "

Although she "thanked" her supporters (really? there are people who think Clute should be a Justice?) there is not a sure victory for Ms. Clute.

Think about the backing, the confidence of only being voted in by less than 50 votes....it isnt too strong.  Will it change the "I think" part of her juris prudence?  What does she think, and what case precedent does she follow?  It used to be George Corn....who is 30 working days from GONE.

Does Clute belong to PACER, WESTLAW, FINDLAW, LEXUS/NEXUS and other judicial and legal sites, and organizations?  Is there really a reverence for the law coming from the locally educated Justice?  How will Clute function if the advice lifeline is gone (Mr. Corn)?  Will Fulbright hang up or not answer if Clute calls and asks how he wants this Defendant handled?

The nail biting will go on through Friday...when the recount will be conducted.  It seems impossible that Robin Clute would tie Nancy Sabo...I mean really!  If the voters actually gave that many votes to Robin Clute, justice does not matter, it is a local popularity contest...with the detriment to those facing this Judge, who takes many suggestions for a living.

If Clute wins, the scalping that this recount did should not make her confident that everyone wants her there, or agrees with her style on the bench.  Justice is not a popularity contest, it can affect lives.  When Clute is there to work locally, instead of independently....thats scary.

Will Clute change in light of the "tie" and actually do a better independent job if elected?  Victims of Clute will shutter if she wins, knowing there is no way she knows what she is doing.  Hamilton needs better judicial representation...and Nancy Sabo was willing to step up once again.

Forgetting and going on is not the answer here.  If Clute wins, it was a near referendum...respond accordingly.  We will be watching....it wont be a free lunch, and your mentor will be gone.

Lets hope fake fingernails and a new hairdo wont help JP Clute forget: the voters dont trust you either.

Prosecute George H. Corn - Ravalli County Attorney for Murder

In true hypocritical fashion, the Ravalli County Attorney has wanted to prosecute the 43rd president for Murder for the war in Iraq.

Isn't it a psychological strategy to shine the light on something else to take light off of your own issues, and possibly criminal behavior? I believe it is called "wagging the dog".

Don't get me wrong, I've read the book which made the case that any county atty could prosecute the matter with respect to George W. Bush....and its compelling. Seems like George Corn signed on as the partisan prosecutor for the Democratic Party in Ravalli County.

Not many people know George Corn is a Democrat, in a very conservative valley and state. Deceptiveness is the first key to criminal behavior. Making allies and alliances within the entities in the Bitterroot valley makes sure he is never questioned, and never loses...even if he is wrong.

In 2005 his "outreach" and services to his constituents went overboard. Judges, on his command such as Justice Robin Clute (his former employee) turned up the heat, and violated citizens rights to reasonable bail. The US Constitution is the silent enemy here, judges hate the 8th Amendment right to reasonable bail. It gets in the way of Corns agenda.

Reasonable for Robin Clute is to follow all orders of George Corn. Usually, this is called being an accomplice; we'll indict Robin Clute for conspiracy to murder. Ignorance to the US Constitution is not an affirmative defense available for JP Clute; neither is stupidity.

The New York Times investigated the suicide rate in the county (twice national average) and the four accomplished in the Ravalli County Detention Center in 2005. Excessive bail was deemed the reason for the suicides. They came from Clute who did not alter or examine the requests from George Corn. When the justice system has no checks against each other, catastrophe happens. When Corn needs to destroy people to feel powerful, we are his subjects, and the local justice system his employees and conspirators.

An example in 2010 of the ludicrous requests: $200,000 for conspiracy to assault with pot in possession. No shooting, no vehicular homicide, no rape. Clute went with Corn's office suggestion. Can stupidity, and arrogance lead to murder? Just ask OJ Simpson.

The Ravalli County Attorney office has no rival, no conscience, no law, nor the US Constitution. We, the people need to understand the deception (The Ravalli Republic Newspaper), the problem...Robin Clute, George Corn, and the solution...voting a person that can reject the Ravalli County Attorney Office and Corn....Justice Nancy Sabo.

Corn and his conspirators who take away our rights, use law enforcement to intimidate us need to be stopped. He is murdering our rights, he contributed to the murder of 4 inmates, and countless lives altered, and destroyed in Ravalli County...for his ego.

Watch one of Corn's deputies in the courthouse sometime. Always being right, always getting your way leads to brats, and dangerous public officials. Corn has bullied commissioners, for any budget he wanted; he has disallowed citizens their right to vote, and petition our government. This is the Declaration of Independence from George Corn, a man who has taken personal pleasure in making lives unnecessarily difficult. Many voices are out there with this same story about George H. Corn Ravalli County Attorney since 1991. Now is the time to be telling your story to your neighbors and friends....they will get around before the election.

His friends such as Max Baucus and Steve Bullock cannot influence your vote. Baucus has helped to keep Corn in office for 20 years. There is evidence that Corn should be indicted for Murder, more so than a President who enjoys complete immunity from liability. Mr. Corn only enjoys a system he alone controls in the Bitterroot, and his liability protection stops at reasonable actions, and knowing that violating rights will make the buck stop at him. Corn may be more of a liability than any publicity from the 2005 suicides.

Voters can hold George Corn accountable on November 2, 2010. Others of us can hold him accountable for how unreasonable he has been with our rights. The dead can haunt him for being so arrogant. Lets let him be as arrogant as he wants, but not on our Payroll in Ravalli County. George H. Corn has murdered thoughts and dreams, and made it seem like it was the Public's or the individuals fault. The former Detainees know the truth: Corn led the justice system that violated their rights and made them give up. Lets change the judicial system with one vote: NOT FOR CORN.

The commissioners must be willing to stand up to Corn. None have. that is for another entry.
